Guess the Guitars Giveaway (the “Giveaway”) Official Rules

1. NO PURCHASE OR BANK TRANSACTION NECESSARY TO ENTER. A purchase or transaction does not increase your chances of winning. Need not be a customer of Wintrust Financial Corporation (“Sponsor”) to enter; becoming a customer will not increase your chances of winning. Void where prohibited.    

2. Eligibility: Giveaway is open to legal residents of the United States and the District of Columbia (excluding FL, NY, RI) who are eighteen years of age (except in the case of residents of jurisdictions where the legal age of majority is greater than eighteen [18] years, such legal age of majority) or older at the time of entry. Employees, officers, and directors (including immediate family members [spouse, parent, child, sibling and their respective spouses, regardless of where they reside] and members of the same household, whether or not related) of Sponsor and its affiliates, the Chicago Cubs Baseball Club, LLC (“Cubs”), the other MLB Entities (as defined below), HSC Plaza and Building Operations LLC (“HSCPBO”), any and all other companies associated with the Giveaway, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, sponsors, printers, advertising and promotion agencies are not eligible to participate. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

3. To Enter: Giveaway begins at 3:00 p.m. Central Time (“CT”) on Thursday, May 22, 2025, and ends at 11:59 p.m. CT on Tuesday, September 30, 2025 (“Giveaway Period”). Participants will receive one (1) entry into the Giveaway when they 1) visit the Wintrust display at located at Gallagher Way; and 2) go to wintrust.com/music to complete and submit the Giveaway form with all requested information during the Giveaway Period.  Or, to enter the Giveaway without obligation, complete the entry form with all requested information and mail to Wintrust Financial Corporation, ATTN: Marketing – Guess the Guitars Giveaway at 9700 W. Higgins Rd., Ste. 550, Rosemont, IL 60018. All mail-in entries must be received by 11:59 p.m. CT on 9/30/2025. Not responsible for late entries. One entry per form; limit 1 entry per person. All decisions made are final.

4. Prize: One (1) prize will be awarded to one (1) winner.  Winner with the correct guess of the total number of guitars that are inside the custom Wintrust box (“Winner”) will receive Five Hundred dollars ($500) paid out via check (“Prize”). In the event no one correctly guesses the exact number of guitars, the prize will be awarded to the participant with a guess that is closest in margin to the correct number.  In the event of multiple correct guesses, the Winner will be determined by a random drawing amongst entrants with the correct guess. Prize will be delivered via mail to the address provided upon Giveaway entry.

5. Prize restrictions: Prizes are non-transferable. Federal, state, and local taxes, and any expenses relating to the acceptance and use of the prize not specified, are the sole responsibility of the Winner. The estimated retail value of each prize is $500; and prize is not IRS 1099-INT reportable. Winners may make no substitution/transfer of prize. Limit one (1) prize per person.

6. Drawing: On or about October 1, 2025. Prize winner will be determined from all eligible entries. Determination will be conducted at Wintrust Financial Corporation, 9700 W. Higgins Rd., Ste. 550, Rosemont, IL 60018.

7. Odds: Odds of being selected as Giveaway winner will depend on the total number of eligible entries received.

8. Winner Notification/Prize Awards: Winner will be notified by email and/or phone number on or about October 1, 2025, and does not need to be present to win. Winner may need to submit information confirming their eligibility. Upon notification, the selected winner has seventy-two (72) hours to claim a prize. After seventy-two (72) hours without a response, the prize may be considered unclaimed. Unclaimed prizes will not be awarded to alternate winners. Subject to verification of eligibility and compliance with these Official Rules, the potential winner will be declared the official winner of the Giveaway (the “Winner”). The decisions of the Sponsor are final and binding on all matters relating to this Giveaway. 9. General Conditions: The decisions of Sponsor are final and binding on all matters relating to this Giveaway. Released Parties (as defined below) are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due, or garbled entries, transmissions, email, or mail; lost, interrupted, or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections; availability, accessibility, miscommunications, or failures of computer, satellite, telephone, cable, or wireless transmissions or lines; computer hardware or software malfunctions, failures, or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines, telephone systems, wireless towers, or cellular tower equipment; any error, omission, interruption, defect, or delay in wireless or other transmission, processing, or communication; printing, typographical, or other errors appearing within these Official Rules, in any Giveaway-related advertisements, or other materials; cancellation or postponement of any Major League Baseball game/event/exhibition; or any other errors, problems, or difficulties of any kind, whether human, mechanical, electronic, or other, relating to the Giveaway, including, without limitation, errors or difficulties which may occur in connection with administration of the Giveaway, processing of entries, announcement of the Prize and/or Winner, or any Giveaway-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users (e.g., hacking) or by any equipment or programming associated with or utilized in the Giveaway. Released Parties are not responsible for injury or damage to entrants or to any other person’s computer and/or wireless device related to or resulting from participating in this Giveaway or downloading materials from or use of the Giveaway website. Persons who tamper with or abuse any aspect of the Giveaway or website; attempt to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices; intend to annoy, abuse, threaten, or harass any other entrant or any representative of Sponsor, Cubs, and/or MLB; or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Giveaway and to resolve all disputes in its sole discretion.  Released Parties (a) make no warranty, guaranty, or representation of any kind concerning the prize (or any portion thereof) and (b) disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

Sponsor and Cubs reserve the right, in their sole discretion, to modify, suspend, extend, or cancel the Giveaway (or any portion thereof) in the event Sponsor is prevented from executing the Giveaway as contemplated herein by any event beyond Sponsor’s control, including but not limited to: fire; flood; earthquake; explosion; public health epidemic or crisis; labor dispute or strike; act of God or public enemy; network or equipment failure; riot or civil disturbance; terrorist threat or activity; war (declared or undeclared); court order; or federal, state, or local government law, order, or regulation. Sponsor also reserves the right, in their sole discretion, to modify, suspend, extend, or cancel the Giveaway (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events corrupt administration, security, fairness, integrity, or proper operation of the Giveaway. In the event of cancellation, Sponsor may elect to identify the winner and award the prize by way of random drawing from among all non-suspect, eligible entries received up to the time of cancellation. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Giveaway.

10. Additional Terms: By participating, entrants agree: 1) to be bound by the Official Rules; 2) the decision of the Sponsor shall be final in all respects; 2) to release, discharge and hold harmless Sponsor, Chicago Cubs Baseball Club, LLC and the other MLB Entities, HSCPBO, any Giveaway prize provider or commercial sponsor, any and all other companies associated with the Giveaway, and each of their respective parents, subsidiaries, affiliates, officers, directors, and employees agents, licensees, distributors, dealers, retailers, printers, representatives, sponsors, advertising and promotion agencies, (collectively, “Released Parties”) from any liability, claims, or damages arising out of their participation in the Giveaway, and the acceptance, use, misuse, or possession of the prize. By entering the Giveaway, each entrant gives their express permission to be contacted by Sponsor by telephone, email, and/or postal mail for Giveaway purposes. By accepting a prize, Winner agrees to, where prohibited by law, the use of their names and/or likenesses for advertising and publicity purposes without additional compensation or consideration. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of Illinois.

11. Limitations of Liability: Sponsor, Chicago Cubs Baseball Club, LLC and the other MLB Entities are not responsible for the printing of or typographical errors in any Giveaway-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due mail, or email entries, or for transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction. Sponsor, Chicago Cubs Baseball Club, LLC and the MLB Entities reserves the right to cancel or modify the Giveaway if fraud or technical failures compromise the integrity of the Giveaway.

12. Arbitration; Class Action Waiver: As a condition of entering this Giveaway, each entrant agrees that (a) any and all disputes, claims, controversies, or causes of action arising out of or relating to this Giveaway or the prize awarded (each, a “Claim”) shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (ii) settled by binding arbitration in Cook County, Illinois before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses.

14. Email Marketing: By entering, you acknowledge Wintrust and its affiliates may send you news, event information, and marketing communications via email. You can, at any time and free of charge, choose not to receive those email communications by clicking on the unsubscribe link within the email, or by opting out at wintrust.com/privacy. Opting out of receiving email communications will not affect your chances of winning.
